These terms and conditions outline the rules and regulations for the use of THE G RADIO, LLC’s website, submission form, social media pages and all other online entities controlled by THE G RADIO, LLC.

It should also be understood that any and all times that our business name appears as "THE G RADIO", that is simply short for "THE G RADIO, LLC".

Any and all times that our company's name appears as "THE G RADIO", it is to be understood that this is short for our full legal name, "THE G RADIO, LLC". They act as & represent one company, our company, the same company.

 

By accessing this website, our submission form, social media pages and any of our other online outlets we assume you accept these terms and conditions. Do not continue to use our outlets if you do not agree to all of the terms and conditions stated on this page.

We reserve the right to amend, remove & add in any information in both these 'Terms & Conditions' & in our 'Privacy Policy' without notifying the public.

 

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person who is accessing this website and compliant to the Company’s terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Netherlands. Any use of the above terminology or other words in the singular, plural, capitalization, and/or he/she or they, are taken as interchangeable and therefore as referring to same.

PACKAGES WE OFFER

We offer four (4) packages - Bronze ($20.00), Silver ($50.00), Gold ($75.00) & Platinum ($100.00). Those prices are considered the ‘sign-up fee’ & are all in USD along with all prices that are listed on any page of ours. The sign-up fee covers the first two (2) months of airplay for the customer’s track on our station, promo on our social media pages, SoundCloud & Spotify promo & a listing on our website plus more. After the initial two (2) months is up, please see the ‘RENEWALS’ section for what comes next. ONLY one track is allowed to be submitted with each package. Customers can submit up to but no more than three packages to us (3 total songs) in a 2-month period. Please note that if you have multiple tracks playing on our station, the guaranteed number of plays for each might not be reached because the DMCA (governing body of online radio stations) rules, that our station abides by, limits the number of plays per artist, per track in a set amount of time.We offer four (4) packages - Bronze ($20.00), Silver ($50.00), Gold ($75.00) & Platinum ($100.00). RENEWALS / TRACK REPLACEMENTS

After the first two (2) months are complete, the customer’s subscription is automatically renewed & charged (USD 10.00) on monthly basis ONLY IF they chose & paid their initial sign-up fee with PayPal. This will occur on the same day each consecutive month until the customer cancels or fails to make the payment. They will have to pay manually if they chose any of our other options (Cash App, Stripe, Venmo, or Bitcoin). Renewals come with (A) airplay at the same spin rate per week that the customer initially signed up for, (B) more social media promo & (C) continued listing of the customer’s stage name, their track title, their online web/social media pages & track download/purchase links on our website (this only goes for Silver, Gold and Platinum Packages buyers). We reach out to each customer 2 - 7 days before their package is either going to expire or renew. In this email, we give them the chance to manually renew (if they chose a payment option other than PayPal). If they chose PayPal, we inform them that they will be automatically charged. Also, in the email, we link them to our track replacement form which gives them a chance to swap in a brand new track. If the customers are currently subscribed to our company with PayPal & being billed automatically but want to opt-out, they can either contact us and we’ll cancel their subscription for them or they can cancel by logging into their PayPal dashboard. Canceling a subscription is free & can be done at any time. The number of plays for your track on our station may reduce in the third month and continue to do so each month (unless a track is submitted to replace it). This makes room for newer artists and tracks, & helps our station not play the same track as much over a long period. If an artist (who is up-to-date on all of their subscription payments) has a track on our station that is 4 or months old, we might switch up the track to another one of theirs and/or upgrade their package to the next highest package. We do this to keep our station fresh with the hottest tracks playing. The artists can switch back to their old track or to a new one if they please, as well. If an artist's subscription is up-to-date on payments and their track has been airing on our station for more than 4 (four) consecutive months, then we may change it to a newer song by the same artist to keep our station fresh.

SOCIAL MEDIA PROMO

We include varying levels of social media promo depending on which of our packages that the customer orders. Also, customers can purchase stand-alone promotions separate from the other benefits we offer (i.e. airplay). The social media outlets that we do promo on are Facebook (@thegradio247), Instagram (@thegradio) & Twitter (@THEGRADIO). To view exactly what promo comes with each package, please see our 'PRICING' page on our website. All promo posts (excluding stories) that are published on each of our three pages stay there forever after being published. In creating all promo posts, we will use the information, images, videos, music, names, titles & all other content that you either (1) provide us on the submission form, (2) send to us via email or direct message, or (3) that we pull off any of your pages. Any content, that is submitted to us, that is explicit or could come off as offensive will either be censored by us or will not be posted.

OTHER PROMO

Separately from the social media promo we do, we also do various other promotions on our website, on Spotify, and on SoundCloud for artists. To view the exact promo details for each of these three outlets, please see our 'PRICING' page on our website.

SOCIAL MEDIA & OTHER PLATFORM FOLLOWS

While stated on the packages that we will follow you on various social media (Instagram & Twitter) & other online outlets (SoundCloud & Spotify) outlets, that can vary due to high demand and limitations on the number of accounts that are allowed to be followed. If we do follow you, we can also unfollow you at any point in time. You CANNOT buy followers, likes, views, comments (or any other types of fake/auto Social Media engagements) from our company. We, also, cannot guarantee that you will gain any followers by joining our platform.

ARTIST OF THE MONTH

On the first day of each month, we announce our ‘Artist of the Month’ on each of our social media pages. On our website’s homepage, for the full duration of the month, we dedicate a section to this artist, their name, and their web links. To be eligible for this, the customer had to have previously purchased either our Gold or Platinum package. Artists are selected at random for this promotion and must currently be active on our platform. Artists reaching out to us and asking to be selected do not carry any weight or have any influence on the draw. Artists cannot be selected for this promotion more than once. No free bonuses or any other benefits will be awarded to the Artist of the Month.

TRACK OF THE WEEK

Every Monday, we announce our ‘Track of the Week’ on each of our social media pages. On our website’s homepage, for the full duration of the week, we dedicate a section to this track, the artist, and the link to it on Apple Music. To be eligible for this, the customer had to have previously purchased our Silver, Gold, or Platinum package. Tracks are selected at random for this promotion and must be currently on our platform. Artists reaching out to us and asking for their track to be selected do not carry any weight or have any influence on the draw. Tracks/artists cannot be selected for this promotion more than once. No free bonuses or any other benefits will be awarded to the artist whose track is selected.

 

PAYMENT METHODS

We offer multiple payment options ensuring that the customer can pay using the method that they feel most comfortable with.
(1) PayPal Subscription - Customers can opt into our subscription where their initial down-payment covers their first two months on our platform. After that, they are billed monthly automatically the $10.00 recurring subscription fee.
(2) PayPal Invoicing - We can invoice the customer the amount they owe using PayPal. This method has to be specially requested by the customer. If the artist wants to remain on our platform after the initial two months that they pay for, they’ll have to manually pay or opt into our subscription.
(3) PayPal money transfer - The customer can simply send the money they owe to our PayPal as a ‘business transfer’ where they’re paying for our services. If the artist wants to remain on our platform after the initial two months that they pay for, they’ll have to manually pay or opt into our subscription.
(4) Cash App - The customer can send the payment to our Cash App $Cashtag ($THEGRADIO) for the amount they owe. If they want to remain on our platform after the initial two months that they pay for, they’ll have to manually pay again or opt into our recurring/automatic PayPal subscription.
(5) Venmo - The customer can send the payment to our Venmo username (@The-G-Radio) for the amount they owe. If they want to remain on our platform after the initial two months that they pay for, they’ll have to manually pay again or opt into our recurring/automatic PayPal subscription.
(6) Bitcoin - The customer can send the BTC amount that is equivalent to the amount they owe us in USD to our Bitcoin wallet address. Also, if they want to pay using a cryptocurrency that is different from Bitcoin (such as Dogecoin), we can make that happen upon special request. If the artist wants to remain on our platform after the initial two months that they pay for, they’ll have to manually pay again or opt into our recurring/automatic PayPal subscription.
(7) Stripe - The customer can pay Stripe, the trusted online credit card processor. If the pay with Stripe, it has to be done right on our submission form, at the very end. If the artist wants to remain on our platform after the initial two months that they pay for, they’ll have to manually pay again or opt into our recurring/automatic PayPal subscription.

SUBSCRIPTION CANCELLATIONS

Subscriptions only apply to those customers who paid their first payment using PayPal thus opting into our subscription service. A customer can cancel their subscription in any of these three ways: (1) By contacting our company and telling us to cancel the subscription. We will cancel it, and you’ll receive a confirmation message from us and another from PayPal. (2) By logging into your PayPal dashboard and canceling the subscription by yourself. In this case, you’ll also receive a PayPal email confirming your cancellation. (3) Lastly, if PayPal tries to obtain your payment and it fails, we’ll give you a few more months before completely removing your track from our platform. Track removals vary in execution time depending on current station traffic, availability & space.

OUR STATION

Our station is available for listening on countless apps and directories across the web. To see exactly which ones, please visit the 'WHERE TO LISTEN' page on our website. The same stream plays across each of these directories simultaneously. All tracks that air on our station were submitted and paid for by the owner of their official rights. All owners paid for the submission knowing that, in exchange for the payment, their track is allowed to be promoted on all of our web pages & aired on our online radio station.

EMAIL

Upon signing-up & paying for any of our services, you give us permission to opt you into our email marketing campaigns. We WILL NOT spam you & you can opt-out / unsubscribe at anytime and not receive anymore emails from our company. Our emails to you will consist of special/new features on our platform, helpful resources to better your career, info about you & your track on our station, news about us & monthly newsletters.

CONTENT DISPLAYED

No logos, music, videos, pictures, or any content may be used, ripped, or downloaded in any way, shape, or form from our website, social media pages, online radio station, or music pages without expressed written consent from our company. Any music, videos, cover arts, logos (other than our own), names, or titles that are displayed on our website, radio, or social media pages is not owned by us. We obtained official permission, from the owners to air/display/promo it. All content is solely for promotional use only for the musical artist, label, producer, composer, writer, etc who submitted it to our company. Most of the music we air is not edited and does contain explicit language, therefore, listeners discretion is advised. We do not have a skip button feature on our station. If explicit material in the form of videos, images, or audio files is submitted to us, we have the right to edit, amend, crop out or not air or display that material.

REVIEW PROCESS

Once a track is submitted with any of our packages (doesn’t matter which), it then goes into a review process which can take up to 72 hours. During this process, our team will listen to the track, check out the artists’ online pages & even listen to some of their other tracks. If the artist is accepted, they are then contacted immediately via email and/or social media direct message. Within that congratulatory message, we’ll also include the payment link and/or instructions so we can get the ball rolling. If a track is NOT accepted, then we’ll reach out to the artist via email and/or social media direct message, thank them for their submission but inform them that their track just is not the right fit at this time.

CONTENT LIABILITY

We shall not be hold responsible for any content that appears on your Website. You agree to protect and defend us against all claims that is rising on your Website. No link(s) should appear on any Website that may be interpreted as libelous, obscene, or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

PARTNER OFFERS / AFFILIATE PROGRAMMING

We have joined various affiliate/partner programs in our niche that share the same target market. We promote them on our platform to our customers on our website, through email marketing & across each of our social media pages. If you click on any of these programs from our website or any of our social media pages and then make a purchase, we earn a percentage of that commission. We do not own the products or set any of the prices.

We offer our own affiliate program. You can view all of its details, rules, regulations & guidelines by going to the AFFILIATES page on our website. Breaking any of these will result in immediate termination of you as an affiliate with our company.

OFFENSIVE / ABUSIVE CONTENT

If any content from our website, social media pages, music pages, or radio station is offensive to you, please report this to us by sending us an email (info@thegradio.com). We will review it and take action within 10 (ten) to 15 (fifteen) days, and contact you with verdict and any actions that we took. At any point in time, we have the right to terminate your subscription thus deleting you and your music off of our platform without any notice, without any refund if we feel you are violating these terms & conditions, being abusive towards our fans, followers, listeners, fellow artists, our company or anyone else associated with our platform or display any other negative, abusive or malicious behavior. Spamming, discriminating, cyber bullying & all other offensive behaviour is not permitted on our platform and is subject to immediate termination without any notice and without any refund.

TERMINATIONS

We reserve the right to immediately remove any artist from our platform who violates any of these terms, conditions, goes against our privacy policy, or commits any immoral/dishonest/heinous act. Terminations can and will be made without any warning or reasoning. No refund will be issued & if the customer has opted into our PayPal subscription, that will be terminated immediately, as well. The customer’s email will be blocked & each of their web/music/social media pages will be blocked, as well.

FREE SUBMISSION OPPORTUNITIES

To earn a free track submission to our company, you must first purchase one of our four packages thus subscribing to our company. Once the subscription is made, you will be presented with two possible opportunities to earn a free track submission. First, we accept shout-outs that air periodically on our station. Second, we accept reviews that may be displayed on our website and on our social media pages. For this option, to earn the free song submission, your review must be detailed & well thought out. Please abide by the rules when submitting either of these or they won’t be accepted and you won’t earn any free track submission. We only accept one of each for a grand total of two (2) total free track submissions that you could earn.

STREAMS

Our station is for promotional usage only. Therefore, by signing up for our service & being aired & featured on our platform, you understand that we do not count toward your streaming numbers/play counts.

​

ROYALTIES

Our station is for promotional usage only. Therefore, by signing up for our service & being aired & featured on our platform, you understand that this will not count towards your overall streaming numbers. With that, you will not be paid out any royalties for having your track(s) air on our station.

 

RESERVATION OF RIGHTS

We reserve the right to request that you remove all links or any particular link to our Website. This request must be approved immediately. We also reserve the right to amend these terms and conditions at any time, without notice. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions.

BREAKDOWN

By buying a package or any promo thus submitting your content & info to our company - you give us the right to, give us permission to, acknowledge that, understand that & agree to:

 

*Play your track on our station.

*Pull any picture of you from one of your social media pages for positive use on your promo post(s) that we publish.

*Display & air your track on our station, on social media posts & on our website.

*Display your stage name on our station, on social media posts & on our website.

*Display the track’s cover-art on our station, on social media posts & on our website.

*Bill you / await for your payment via the payment method that you chose.

*Involve you in various social media polls & stories.

*The number of plays for your track will reduce & continue to reduce from the third month on due to over-capacity on the station and to give way for newer tracks & artists.

*After paying the initial sign-up fee, after the two (2) months conclude, you will be automatically billed via PayPal. This is for package purchases ONLY, not promo purchases.

*We will not store any personal or credit card information as that is all handled by our payment processors. We do not even see this information.

*You own the track and all rights to it.

*All orders are marked completed after five (5) days and no refund will be given. If a refund is requested before those five (5) days are up, then a refund for the full amount of the package purchased will be issued to the customer.

*At any point in time, we have the right to terminate your subscription thus deleting you and your music off of our platform without any notice, without any refund if we feel you are violating these terms & conditions, being abusive towards our fans, followers, listeners, us or anyone else associated with our platform or display any other negative, abusive or malicious behavior. Spamming, discriminating, cyber bullying & all other offensive behavior are not permitted on our platform and are subject to immediate termination without any notice and without any refund.

*Any and all information, guidelines, content, rules & restrictions stated here directly or indirectly you agree to abide by and follow.

 

If any issues should arise and are not stated directly or indirectly in these terms and conditions, we will make the final ruling as to what will be the outcome. These would then be updated accordingly to accommodate the issue specifically.

PRIVACY POLICY

THE G RADIO, LLC is committed to protecting the privacy of our online visitors.  Online visitors who wish to pay for a song submission must provide the correct info to whichever payment processor they choose so that the transactional will be successful.  THE G RADIO, LLC does not see or keep any credit card/bank info.  That entire process is all handled through whichever secure payment processor you choose. 

 

All online visitor data collected by THE G RADIO, LLC is protected against unauthorized access.  We will not sell, trade, or give your personal information to other companies or organizations.  The only information we will list on our website comes from the song submission form you fill out after payment is made.  That information, found in the MUSIC section, includes your stage name, song title, producer of the song, any featured artists, social media links (like Facebook, Twitter, SoundCloud, Instagram, etc), your official website, and other streaming/online music stores to purchase your song online (such as iTunes, Amazon Music, Tidal and Spotify). 

 

Children's Privacy:

 

We do not knowingly collect personal information from children under the age of 13.  If we learn that we have personal information on a child under the age of 13, we will delete that information from our systems.  THE G RADIO, LLC encourages parents to go online with their kids.  Here are a few tips to help make a child's online experience safer:

• Teach kids never to give personal information, unless supervised by a parent or responsible adult. Includes name, address, phone, school, etc. 

• Know the sites your kids are visiting and which sites are appropriate. 

• Look for Web site privacy policies.  Know how your child's information is treated.
